A 55-year-old Sterling Heights man who was arrested in Utica for allegedly driving a stolen motorized wheelchair down Greeley Street while drunk last week faces charges for his seventh operating under the influence.

A warrant has been issued for Raymond Kulma on charges of OWI. Kulma had 10 days from the time the warrant was issued to turn himself in for a formal arraignment on the charges.

Kulma was arrested on May 27. The incident began when Utica police were called about an assault on Greeley Street and stopped two men in a vehicle.

The details of the alleged altercation are not clear but police said Kulma, who was "highly intoxicated" stole one of the men's motorized wheelchair. When police arrived to question Kulma, they found him driving the wheelchair down the road.

Kulma was arrested after officers discovered he had a .241 blood alcohol content during a breathalyzer test. Kulma was taken back to the Utica police department and released after he sobered up.

Utica Police said this incident will mark the seventh time Kulma has been charged with operating while under the influence.

The Americans with Disabilities Act says a person in a wheelchair is a pedestrian. While this idiot may well deserve being arrested and SO much more, he has a leg to stand on in court...

I hate to say I agree with this. A motorized scooter is considered a enabling device, like a cane or seeing eye dog. The guy is just publicly intoxicated. He could get hit with theft of property.

The motorized wheelchair drivers are dangerous and many think they own the road, imo.
