Judge Signs Shelby Woods North Consent Judgment

A Macomb County Circuit Court Judge signs a consent judgment Tuesday giving Shelby Township more authority over maintenance and safety at Shelby Woods North Condominiums on 22 Mile Road.

An amended consent judgment that would give Shelby Township more authority over the general maintenance and safety at Shelby Woods North Condominiums on 22 Mile Road was filed in Macomb County Circuit Court.

Shelby Township attorney Rob Huth told Patch that Judge James Biernat signed the consent judgment on Tuesday.

“The amended consent judgment allowed for a lot split of the property and in return, the township obtained some additional tools to help keep the common areas and such on par with the township’s ordinances,” said Huth.

After a , where several Shelby Woods North Condo owners aired their grievances with the developer and the lack of maintenance at the condo complex, Shelby Township agreed to send Tim Wood, township building director, to the site to file their complaints.

After meeting with several residents to address their concerns, Wood said at Tuesday’s board meeting that the consent judgment will now allow him to come into the complex and demand the builder care for the common areas.

“If it’s an issue that the township believes should be taken care by the developer, there is a process that escalates the township’s action. The township can take care of the problem now and then bill the developer,” said Huth.

However, Wood cautioned that some of the resident’s complaints are outside the township’s scope, and the township’s main priority is the safety of the residents.

“The township has regulations that safeguard public health and safety,” said Wood.

The after developer Joe Caradona asked the board of trustees to approve a change in the consent judgment that would allow him to convert some condos into apartments and sell the complex to Bill Scalabrino.

However, it has taken more than 13 months to finalize the consent judgment and get it signed by a judge.
