Jailed Man Charged with Retail Fraud

The Utica Police Department solved a crime that occurred at on Sept. 18, according to Chief Dave Faber.

Loss prevention officers at Sam's Club on Hall Road called the Utica police to report the theft of a flat screen TV. When Utica officer Gregory Morabito saw the store's surveillance video of the theft, he immediately recognized the suspect as 26-year-old John Nicholas.

Morabito had come in contact with Nicholas while working in Utica and in the Transient Crimes Force Task of Macomb County. Morabito remembered Nicholas was being held in the Macomb County Jail on an unrelated assault charge.

When Morabito visited Nicholas in the Macomb County Jail, police said Nicholas confessed to stealing the TV by walking out the front door of Sam's Club. Nicholas told the person at the front door that he was trying to return a TV to the store, but he was denied.

Nicholas told police that another man, Paul Lawrence, allegedly told him to steal the TV from Sam's Club. Nicholas said he and Lawrence got into a physical altercation because Lawrence then tried to steal the TV from Nicholas, and that's why Nicholas was arrested on assault charges. According to a police report, Lawrence, whose real name is Paul Loren, was listed as the victim on the assault case.

Morabito said on a police report that he is still trying to track down the stolen TV.

Nicholas was charged with first-degree retail fraud.
